Calverley Square Compulsory Purchase Order

At a Cabinet meeting on the 19th July 2018 Tunbridge Wells Borough Council (the "Council") resolved to make the Tunbridge Wells Borough Council (Calverley Square) Compulsory Purchase Order 2018 (the "Order") to acquire land and new rights over certain land in Tunbridge Wells as part of the Calverley Square development. The Order was made on 20 August 2018.

The Council submitted the Order to the Secretary of State for Housing, Communities and Local Government for confirmation on 6 September 2018. If the Order is confirmed, it will authorise the Council to purchase compulsorily the land and the new rights set out in the Schedule attached to the Order.

A 21 day consultation period concluded on 17th September 2018. During this consultation period, the Council received a number of objections to the Order. A number of those objections raised similar issues not specific to an individual property. The Council has therefore produced the following Combined Objection Response Document in response to the non-property specific issues raised.

Compulsory Purchase Order Public Inquiry

On 17th October 2018, the Planning Inspectorate confirmed the requirement for a public inquiry relating to the Order to be held. The date and location for the inquiry is to be set in due course, and is likely to be held in spring next year. As part of the inquiry, the Council is submitting a Statement of Case in support of the Order. The documents forming this Statement of Case can be found in our Statement of Case Documents.

The Calverley Square Compulsory Purchase Order

The Order is made under Section 226(1)(a) of the Town and Country Planning Act 1990, Section 13 of the Local Government (Miscellaneous Provisions) Act 1976 and The Acquisition of Land Act 1981.

A copy of the Order and of the accompanying map have been deposited at:

1.Tunbridge Wells Council Gateway, 8 Grosvenor Road, Tunbridge Wells, TN1 2AB; and,
2.the Library, Civic Way, Tunbridge Wells, TN1 1NS

These can be viewed during normal opening hours.

The opportunity to object to the Order ended on 17 September 2018.
