When do we collect information from you?

We collect information from you when you visit our website.  We also collect personal data when you contact us in writing, speak to us on the phone, email us or contact us using other types of electronic communication, or talk to us face to face.

What types of information do we collect from you?

We collect your name, address and date of birth. We may also capture your vehicle registration details and notes of any offence you have committed.   We may also capture CCTV images of you, video footage of our conversation with you or still photographs of evidence relating to an offence.

What is our legal basis for using your information?

To provide street scene enforcement services within the borough because it is in the wider public interest to do so.

Why do we collect this information?

We collect this information from you for one or more of the following purposes:

  • Information action and advice
  • Fixed penalty notices
  • Statutory notices, community protection notices
  • Siezure of goods, equipment or vehicles
  • Dog enforcement
  • Simple caution
  • Prosecution
  • Proceeds of crime applications

We may also use some of your information, such as CCTV images or video recordings for:

  • Investigating complaints made against the Council
  • Prevention and detection of crime, including fraud
  • Employee safety and well being

Sometimes we have to give it to other authorities, organisations or people.  This would be for the prevention or detection of crime, or because of legal matters, for example.  We don’t need your consent to do this, but if we can, we’ll let you know if we’ve passed your information on.  We won’t use it for any other purpose without your consent, or without telling you first.

Anonymised and pseudonymised data may be used for research & statistical purposes.  Any data collected may be used for research and statistical purposes that are relevant and compatible with the purpose that the data was collected for.

Who might we share your information with?

Your information is stored by Maidstone Borough Council on our behalf. You can view their privacy information at https://www.maidstone.gov.uk/home/privacy-and-cookies.

Kent County Council will also use your information. They may use it for their own reasons that are different to ours, but they still have to look after it in the same way. If you make a payment to us, Civica will also use your information, but only on our instructions. They won’t use it for any other reasons, and they have to look after it in the same way we would. You can view their privacy information here.

How long will we keep your information for?

In line with our record retention schedule, records and evidence relating to the issuing of fixed penalty notices and prosecution case work will be kept for 6 years.
